This Privacy Notice is meant to help you understand what information we collect, why we collect it, and how we process information.

We may update our privacy notice from time to time. We will notify You of any material changes by posting the new Privacy Notice on this page. You are advised to review this Privacy Notice periodically for any changes. Changes to this Privacy Notice are effective when they are posted on this page.

This privacy notice applies to data collected through services provided by Yarbo International, Inc and its affiliated companies, (collectively "Yarbo", "we", "us" and "our"), including application and Internet of Things (IoT) devices (collectively "Yarbo Products"). This privacy notice describes the information practices for Yarbo Products, including what types of information are collected, how Yarbo uses information and for what purposes; with whom information is shared; and how Yarbo protects information. It also describes your choices regarding use, access, correction and deletion of your personal information, among other topics.

1.2 Definitions

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Account means a unique account created for You to access our Service or parts of our Service.

Affiliate means an entity that controls, is controlled by or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for the election of directors or other managing authority.

Application means the software program provided by Yarbo International Inc. downloaded by You on any electronic device.

Company (referred to as either "the Company", "Yarbo", "We", "Us" or "Our" in this Agreement) refers to Yarbo International Inc., 1951 Ocean Avenue Unit 3, Ronkonkoma, NY 11779, United States, including its parent company, subsidiary company, affiliated company and so on.

Device means any device that can access the Service including but not limited to computers, cellphones or digital tablets.

Personal Data means information that is about any individual, or from which any individual is directly or indirectly identifiable, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that individual.

Sensitive personal information means a particular category of personal information relating to topics such as confidential medical facts, racial or ethnic origins, political or religious beliefs, or sexuality. The Company does not collect or store sensitive personal information.

Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.

Usage Data refers to data Our Service collected, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).

You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

2. Types of Data We Collect

Account Information. To perform and provide service to you, we will collect your Yarbo ID and related account details, including email address (or phone number, based on the country location), country, nickname, address, account status, or other information for account verification through Auth0 of Okta Inc.

Device Information. When activating Yarbo products, request after-sales service, upgrade the firmware, you may provide us with information about your Yarbo device, including model, serial number, base station information, operational status.

Mobile Information. To connect with our service, and receive the notification, we may collect certain information, including, but not limited to, the type of mobile device You use, Your mobile device's unique ID, the IP address of Your mobile device, Your mobile operating system.

Contact Information. Information may be provided when you place an order with Yarbo, or connect us for customer services, such as name, Email, correspondence address, shipping address, phone number, or other contact information.

Transaction Information. To perform the service to you, we will collect data about purchases of Yarbo products and services or transactions facilitated by Yarbo, including purchases on Yarbo platforms. Examples are the serial number and model of the product you purchased, the place and time at which the product was purchased, whether the product has been repaired, the type of service purchased, information about the purchase order, and the record of our communications with you about your product.

Survey and research information. On the basis of obtaining your explicit consent, we may conduct some survey activities, and collect some information such as your age, family information, employment information (such as position, location, etc.), and your product preferences and service preferences.

Location Information. In order to ensure the normal operation of the device, as well as to prevent the product from being lost and unable to be retrieved, when You use Our Services through the device, the device will send us the data of device's precise location.

Map Information. To perform and provide service to you, when you use our device to draw maps for device operation, we collect the planar structure of this map, including Map boundaries, No-Go Zones, Vision Zones, recorded paths, Docking Station positions, Map's GPS information, device IP and MAC addresses, and with your consent these maps will upload to our cloud servers in AWS US.

Photos and videos. We may collect your photo with your consent, when you choose to upload your photos, videos or other content by using Yarbo's service, these contents may be stored in our cloud server in AWS US.

Communications. When you contact us for achieving after-sales service or other services, we may collect information about your communications with us, including your contact information, and the time, topic, user feedback, survey data, and content of your communications.

Content and Advertising Data. In order to provide you with better product information, with your consent, we may collect records of ads and content displayed on your page or application screen, and records of your interactions with our online ads and content. We do not share this information with third parties for cross-context behavioral advertising.

Log information Data. In order to understand the operation of the equipment and services and to troubleshoot software and hardware failures, we collect log information about the robot hardware, such as information about hardware device model, hardware serial number, time stamp of the failure, IP address, pages opened when used at the time of the failure, and other software or hardware information related to the failure.

Special Note: If the information we collect cannot be identified individually or in combination with other information, it is not personal information in the legal sense. If local laws treat some information as personal information, we also treat such identifying marks as personal information. In addition, we sometimes combine non-personal information collected through these technologies with other personal information that we hold. When we combine information in this manner, we will treat the combined information as personal information for the purposes of this Privacy Notice.

You have the right not to provide the personal data we request from you. But if you choose not to provide, in many cases, we will not be able to provide you with our products or services, or respond to your request.

3. Use of Your Personal Data

3.1 We may use Personal Data for the following purposes:

To provide and maintain our Service, including monitoring the usage of our Service.

To manage Your Account: to manage Your registration as a user of the Service. The Personal Data You provide can give You access to different functionalities of the Service that are available to You as a registered user.

Hardware and software function analysis and troubleshooting: We will use the information collected, such as hardware device information, operation logs, network logs, etc., to analyze the operational status of our product services and ensure the normal operation of the services.

For the performance of a contract: the development, compliance and undertaking of the purchase contract for the products, items or services You have purchased or of any other contract with Us through the Service.

Account security identification and anti-fraud: We collect account password credentials and other information, security tips for account security identification and anti-fraud, to protect user account security.

Optimization of our products and services. We may collect your data to optimize our products and services, such as improving our algorithms, enhancing product features, and facilitating upgrades.

To contact You: To contact You by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application's push notifications regarding updates or informative communications related to the functionalities, products or contracted services, including the security updates, when necessary or reasonable for their implementation.

To provide You with news, special offers and general information about other goods, services and events which we offer that are similar to those that you have already purchased or enquired about unless You have opted not to receive such information.

To manage Your requests: To attend and manage Your requests to Us.

For business transfers: We may use Your information to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by Us about our Service users is among the assets transferred.

For other purposes: We may use Your information for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Service, products, services, marketing and your experience.

Abide by laws and regulations: To comply with applicable law or lawful government requirements.

3.2 We may share Your personal information in the following situations:

With Service Providers: We may share Your personal information with our service providers, to monitor and analyze the use of our services, or to help us market our products and services, and to contact You.

With Affiliates: We may share Your information with Our affiliates, in which case we will require those affiliates to honor this Privacy Notice. Affiliates include Our parent company and any other subsidiaries, other companies controlled by the actual controller of Our, joint venture partners or other companies that We control or that are under common control with Us.

With business partners: We may share Your information with Our business partners to offer You certain products, services or promotions to fulfill the purposes stated in this notice. Our business partners include our vendors, service providers, and other partners. We will only share your personal information for lawful, legitimate, necessary, specific, and explicit purposes, and authorized partners will only have access to the information they need to perform their duties and will not be authorized to use the personal information shared for purposes other than the products or services they provide. We do not collect and do not allow partners to collect personal information involving Minors/children.

We will provide them with your name, phone number, purchase information, and location information to provide equipment diagnostics, machine fault analysis, logistics and delivery services for purchased goods. We will provide them with your name, phone number, email address, vehicle model information to facilitate telephone callbacks, send letters, emails or messages, clean customer information, analyze data, provide marketing assistance, conduct customer satisfaction surveys, address customer inquiries and requests, and provide related services with your explicit authorization.

With Your consent: We may disclose Your personal information for any other purpose with Your consent.

Others: We may also disclose information about you if we determine that disclosure is necessary or appropriate for reasons of national security, law enforcement, or other matters of public importance.

We will process Your personal information where there is a legal basis and take necessary technical and management measures to protect your personal information security. We will sign strict confidentiality agreements with companies, organizations and individuals with whom we share personal information and require them to handle personal information in accordance with our instructions, this Privacy Notice and any other relevant confidentiality and security measures.

3.3 Retention of Your Personal Data

The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Notice. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

The Company will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of Our Service, or We are legally obligated to retain this data for longer periods.

During the retention period, we will make every reasonable effort to protect the security of users' personal information, and we have taken and will continue to take the following safeguards.

(1) Our network services adopt transmission security protocols, encryption and other technologies to provide browsing services in a secure manner to ensure the safety of user data during transmission and preservation.

(2) Manage and regulate the storage and use of customer information by establishing a data classification and grading system, data security management norms, and data security development norms.

(3) Establish a strict data use and access system and adopt strict data access rights control and multiple identity authentication technology to protect information security and avoid data being accessed and used in violation of the law.

(4) Adopt specialized data and technical security audits and set up several measures for log audits and behavioural audits.

(5) Organize training courses on security and privacy protection to enhance employees' awareness of the importance of protecting information security.

Please understand that since there is no absolute security in the Internet environment, we will do our best to provide security measures for your information, but it is not always possible to guarantee 100% security. We strongly recommend that you assist us in keeping your personal information secure by using secure methods and complex passwords. If you discover that your personal information has been compromised, particularly your account or password, please contact us immediately using the contact information provided in this Privacy Notice so that we can take appropriate action.

When a personal information security incident unfortunately occurs due to an accident, force majeure, etc., we will try our best to control the situation and promptly inform you of the cause of the incident, the security measures we have taken, the security measures you can take on your own initiative, and other relevant circumstances. At the same time, we will report to the appropriate competent authorities in accordance with the requirements of laws and regulations.

3.4 Transfer of Your Personal Data Internationally

Because of the international nature of our business and our use of service providers located in different regions, we transfer Personal Data to other countries whose data protection frameworks may differ from those in your country of residence. Where such transfers involve Personal Data of individuals located in the EEA, the UK, or Switzerland, we take steps designed to ensure your Personal Data continues to receive an adequate level of protection, which may include contractual, technical, and organizational safeguards. Please note that when you transfer any Personal Data directly to us established outside the UK, Switzerland, or the EEA (as applicable), this is considered a direct collection. We will nevertheless process your Personal Data, from the point at which we receive such data, in accordance with the provisions of this Privacy Notice.

3.5 Product Improvement Analytics and Required Diagnostics

We use Google Firebase to help keep the Yarbo app secure, stable, and easy to use. The information involved consists of device and diagnostic information (such as device model, app version, crash and performance data, and technical identifiers such as an app-instance ID and IP address). We do not use this information to sell your personal information or for third-party advertising, and we do not enable Google Ads linking or Google Signals.

3.5.1 Required diagnostics

Crash and performance monitoring are necessary to operate and secure the app. They are always active and are not disabled through the app, except where applicable law requires us to offer that option.

3.5.2 Product-improvement analytics

We also use analytics to understand how features are used so we can improve the product. If you are in the EEA, the UK, or Switzerland, this analytics is used only with your consent. You can withdraw your consent at any time by contacting us at support@yarbo.com, and we will stop this analytics collection for you. In other regions, this analytics may be on by default; you can also contact us at support@yarbo.com to opt out.

3.6 Legal Bases for Processing (EEA, UK, and Switzerland)

Where the GDPR or UK GDPR applies, we rely on the following legal bases to process your Personal Data: (a) performance of a contract, for account management, order fulfillment, warranty and after-sales service, and delivery of the core functions of your Yarbo device; (b) your consent, for precise device location data, photos and videos you upload, survey and research information, product-improvement analytics in the EEA/UK/Switzerland, and marketing communications; (c) our legitimate interests, for security, fraud prevention, required diagnostics, and product improvement, provided these are not overridden by your rights; and (d) compliance with a legal obligation, for responding to lawful requests and meeting regulatory requirements. Where we rely on consent, you may withdraw it at any time, without affecting processing carried out before withdrawal.

3.8 Disclosure of Your Personal Data

3.8.1 Business Transactions

If the Company is involved in a merger, acquisition or asset sale, Your Personal Data may be transferred. We will provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Notice.

3.8.2 Law enforcement

Under certain circumstances, the Company may be required to disclose Your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).

We are not aimed at minors under the age of 16 (or a lower age where permitted by applicable law), and we do not knowingly collect Personal Data from them.

If You are a parent or guardian and You are aware that Your child has provided Us with Personal Data, please contact Us. If We become aware that We have collected Personal Data from minors without verification of parental consent, We take steps to remove that information from Our servers.

5. Your legal rights

We value the user's right to control his or her own personal information and have taken multiple measures to ensure that the user can exercise the following legal rights with respect to his or her personal information. For security purposes and to prevent causing a breach of personal information, we may ask you to verify your identity first - you will need to provide a written request or otherwise prove your identity; then we will process your request.

5.1 Access to your personal information

You have the right to access your personal information, except for the exceptions provided by law and regulations. If you are unable to manage that personal information in the manner described above, please contact us at support@yarbo.com.

5.2 Correction of your personal information

If you discover an error in the personal information we process about you, you have the right to correct or update the incorrect or incomplete information, or if you are unable to do so on your own in the Account Center, contact us at support@yarbo.com.

5.3 Delete your personal information

You can make a request to delete personal information to us at support@yarbo.com.

If we complete removal, we will stop providing you with the product or service.

Please note that because of applicable laws and security technology, we may not be able to immediately remove the corresponding information from the backup system. In this case, we will store your personal information securely and isolate it from any further processing until the backup can be erased or anonymization is achieved. We will eventually delete and anonymize your personal information in our possession, etc.

5.4 Copy and transfer your personal information

You have the right to request the transfer of your personal information to other data controllers in a structured, common format.

If you need to copy the personal information we collect and store, contact us at support@yarbo.com and follow its arrangements. If you need to transfer personal information stored by our mobile phones, contact us at support@yarbo.com and follow its arrangements; we will provide you with a transfer path as required by law and regulation.

5.5 Refuse to allow others to process your personal information

You have the right to object to certain types of processing, including processing for direct marketing and, in certain circumstances, processing of personal information based on our legitimate interests. You have the right to request that we restrict the processing of your personal information. Contact us at support@yarbo.com and we will evaluate your request for restriction. If the legal and related requirements are met, we will process your information according to the applicable circumstances and notify you before lifting the restriction.

5.6 Change the scope of your authorized consent

Each business function requires some basic personal information to be completed (see Part I of this policy). Contact us at support@yarbo.com to give or withdraw your consent to authorization. You need to understand that when you withdraw your authorization, we cannot continue to provide you with the specific features and/or services for which you have withdrawn your authorization.

When you withdraw your consent or authorization, we will no longer process your personal information accordingly. However, your decision to withdraw your consent or authorisation will not affect the processing of personal data previously carried out on the basis of your consent or authorization.

You can cancel your registered account at any time. Contact us at support@yarbo.com to cancel your Yarbo account.

After you voluntarily cancel your account, we will stop providing you with products or services, delete your personal information or anonymize it as required by applicable law.

5.8 Respond to your request above

In addition to the above rights, you may have other relevant rights in accordance with the laws applicable to you, including possibly: the right not to provide your Personal Data to us; the right to withdraw consent; and the right to lodge complaints with Data Protection Authorities.

In principle, we do not charge a fee for your reasonable requests, but we will charge a cost fee for repeated requests that exceed reasonable limits, as appropriate. We may refuse requests that are unwarrantedly repetitive, require excessive technical means (for example, requiring the development of new systems or fundamental changes to current practices), pose a risk to the legitimate interests of others, or are highly impractical (for example, involving the backing up of stored information). When we deny your request, we will clearly state the reasons and basis for the denial.

Our Service may contain links to third party platforms that are not operated by Us. If You click on a third-party link, You will be directed to that third party platforms. We strongly advise You to review the Privacy Notice of every platforms which you visit.

7. Privacy Notice Update

If we decide to change our Privacy Notice, we will publish those changes in this Policy and where we deem appropriate.

If you continue to interact with us or continue to use YARBO products and services after this policy update takes effect, you have fully read, understood and accepted the updated policy and are willing to be bound by the updated policy.

In certain situations, we may allow you to continue using the Yarbo software without updating it, but you will still be required to adhere to the latest Privacy Notice.

8. Rights for Residents of California

This section applies to California residents whose personal information is processed by us under the California Consumer Privacy Act ("CCPA"), as amended by the California Privacy Rights Act ("CPRA").

In the preceding 12 months, we have not sold personal information for monetary or other valuable consideration, and we have not shared personal information for cross-context behavioral advertising purposes through our Services. We have not sold or shared the personal information of consumers under 16 years of age.

Subject to verification of your identity and to exceptions under applicable law, you have the right to know the personal information we collect and how we use and disclose it; to correct inaccurate personal information; to delete personal information we collected from you; to opt out of the sale or sharing of your personal information; and to limit the use and disclosure of sensitive personal information. Because we do not sell or share personal information as defined by the CCPA, no opt-out is currently necessary; if this changes, we will update this Notice and provide the required mechanism, and we will honor opt-out preference signals (such as the Global Privacy Control) where applicable.

We will not discriminate against you for exercising any of these rights.

You may use an authorized agent to submit a request on your behalf, provided you give written authorization and we can verify your identity. If we deny your request, you may appeal by emailing support@yarbo.com.

9. Rights for Individuals in the EEA, UK, or Switzerland

This section applies to individuals in the European Economic Area ("EEA"), the United Kingdom ("UK"), or Switzerland whose personal information is processed by us under the GDPR and the UK GDPR. Yarbo International, Inc. is the controller of your Personal Data; you can reach us on data protection matters at support@yarbo.com.

Subject to applicable law, you have the right to access, correct, delete, restrict, or object to the processing of your Personal Data; to data portability; to withdraw consent at any time (without affecting processing carried out before withdrawal); and to lodge a complaint with your local supervisory authority. To exercise any of these rights, contact us at support@yarbo.com. You may use an authorized agent, subject to written authorization and identity verification.

Your Personal Data may be transferred to and processed in countries whose data protection frameworks differ from those in your country of residence. Where we make such transfers, we take steps designed to ensure an adequate level of protection, which may include Standard Contractual Clauses and appropriate supplementary measures. Contact us at support@yarbo.com for more information about the safeguards applicable to a particular transfer.

We retain your Personal Data only for as long as necessary for the purposes described in this Notice, taking into account applicable legal, accounting, and reporting requirements, after which we delete or anonymize it.
